Terms & Conditions

In short: we keep ownership of the work we create, and you get a 12-month licence to use it on your website and social channels, with a credit to us. If you'd like to use it anywhere else, just talk to us first and we'll agree the right licence together.

1. Who we are

These terms apply to all work, content and services supplied by DRGNFLY Productions Ltd, trading as DRGNFLY ("DRGNFLY", "we", "us"), a company registered in England and Wales. "You" or "the client" includes your organisation and its staff. By booking a project, paying an invoice, buying a Signal report or using this website, you ("the client", "you") agree to these terms. If a signed agreement or written proposal says something different, that document applies to the point it covers.

2. Ownership of content

DRGNFLY and the creatives we work with are the authors and owners of everything we create for you. That includes film, video, photography, audio, edits, scripts, written copy, designs, graphics, concepts, treatments, raw footage, outtakes and project files ("the Content").

Under the Copyright, Designs and Patents Act 1988, all copyright, moral rights and other intellectual property in the Content stays with DRGNFLY or the creative concerned, unless we agree in writing to transfer it. Paying for a project buys a licence to use the Content. It does not transfer ownership.

We do not hand over raw footage, unedited images or working files unless this has been agreed and priced in writing.

3. Your standard use licence

Once your invoice is paid in full, you receive a non-exclusive, non-transferable licence to use the final delivered Content on:

  • your own business website, and
  • your own organic (unpaid) social media channels, such as Instagram, Facebook, LinkedIn, X, TikTok and YouTube.

The standard licence covers your business only, in the United Kingdom and online, for 12 months from delivery. You can renew it each year. Longer terms (24 months) or a perpetual licence for a one-off fee are available on request.

If the Content is made for your own client (for example, you are an agency), the licence passes to that end client instead. We will name them on the estimate and invoice.

Exclusive licences, where we agree not to licence the same Content to anyone else, are also available for an extra fee.

When a licence ends, you don't need to delete posts already published during the licence period, but you may not publish the Content again or use it anywhere new without renewing.

4. Changes you may make

So the work can fit each platform, you may:

  • resize it and crop it lightly;
  • reformat it for a platform (for example square, vertical or widescreen versions);
  • add your own captions, subtitles or simple text on top.

Without our written agreement, you may not:

  • change its colours or grade;
  • heavily edit, re-cut, combine or alter what it shows or means;
  • remove watermarks, credits or metadata;
  • use it to train, prompt or fine-tune any AI or machine-learning system.

5. Any other use must be agreed first

Any use outside the standard licence must be discussed with us, and the fee agreed in writing, before the Content is published or shown anywhere. Extended licences are available for, for example:

  • paid advertising and boosted or sponsored social posts;
  • PR and news media: newspapers, tabloids, magazines, broadcasters and news websites, in print or online, including Content supplied to journalists, editors, press agencies or PR agencies;
  • wider commercial and marketing campaigns, events, exhibitions, pitches or award entries;
  • print of any kind, including brochures, packaging, outdoor and merchandise;
  • television, cinema, radio and other broadcast;
  • use outside the UK or for longer than the licence period.

You may not sublicense, sell, transfer or share the Content with any third party, including partners, agencies, platforms or your own clients, unless we agree in writing.

Using Content outside the licence without written agreement is a breach of these terms and an infringement of copyright. We may charge a licence fee for the unauthorised use, at our standard rates for that use plus a reasonable uplift, and may ask for the Content to be removed.

6. Credit

Credit is part of the licence. On your website, you must credit the Content near it or on the same page as "Film by DRGNFLY Productions Ltd", with a link to drgnflyproductions.com.

On social media, you must tag @drgnflyproductions or name DRGNFLY Productions Ltd in the caption. Our moral right to be identified as the author is asserted.

7. Our use of the Content

We may use the Content, and your name and logo, in our portfolio, website, showreel, social channels, case studies and award entries. If anything is confidential, tell us in writing before the project starts and we will agree what we can show and when.

8. Your materials

You keep ownership of anything you supply to us, such as logos, products, footage, music or text. You confirm you have the right to let us use it, and you are responsible for any third-party permissions it needs. You give us a licence to use it to deliver your project.

9. People, locations and music

Unless agreed otherwise, you are responsible for permissions from people appearing on camera on your behalf and from locations you arrange. Music and stock we licence is covered for the standard use licence only; wider use may need extra licences at extra cost.

10. Quotes, payment and cancellation

Deadlines, licence scope and fees are agreed in your estimate. Quotes are valid for 30 days.

  • A 50% deposit is due to confirm any commissioned film, video or photography project.
  • Existing clients who pay in full at booking may be offered a 5% discount, at our discretion.
  • The balance is due within 7 days of delivery.
  • Balances more than 7 days overdue incur a 5% late fee, plus a further 5% for every extra 7 days they remain unpaid.

The licence in section 3 only starts once payment is received in full; until then, the Content may not be published.

If you cancel more than 7 days before the shoot or event, we refund your deposit in full. If you cancel within the final 7 days, we may keep 20% of the total fee. Instead of cancelling, you can move your booking once, keeping your deposit against the new date.

11. Revisions and approval

We edit to a high professional standard. We can't control weather or event lighting, but we will always work to deliver images and films worth sharing. Before final download, we send you a review link so you can comment and give feedback. Once you download the final Content, the job is closed and any final invoice is sent.

Each project includes the rounds of revisions set out in your proposal. Further changes are charged at our standard rates. Once you approve a stage, or publish the Content, it is treated as accepted.

12. Signal reports and subscriptions

Signal reports, refreshes and 30-day plans are for your own business use. You may not resell, republish or share them with third parties. Subscriptions renew until cancelled from your account, and cancellation stops future renewals without refunding the current paid period. Recommendations are editorial guidance; we do not guarantee particular results.

13. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, our total liability for any project is limited to the fees you paid for it, and we are not liable for indirect losses, lost profits or lost opportunities. Your statutory rights as a consumer, if you are one, are not affected.

14. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
